Case s and Materials on the Regulation and Litigation of Insurance, 3rd Edition (University book) (University book Series)
₱ 15,286.00
Galleon

The Third Edition brings this casebook up to date on the most recent cases and developments in insurance law. Including but going beyond the basics of insurance contract, tort, remedies and commercial law regulation and litigation, this book highlights insurance law in action using the business as a proving ground for federal-state relations, for the powers of administrative agencies and corporate governance, and for new formulations of tort and statutory law. It traces the fortunes of the business from Lloyds coffee house and before to the Trade Towers and after. This book is ample for at least a three-hour course. It lends itself to a shorter one, and in either case, by variety, to selective emphasis. An instructor might choose to emphasize the popular lines of insurance, policy terms in general use, and advocacy in insurance disputes. Another might emphasize regulation of the insurance business, giving particular attention to tension between federal and state authorities. One might venture into various fields of social and economic science. The behavior of buyers and sellers of insurance has drawn increasing attention from economists, who find it sometimes a challenge to, and sometimes a vindication of, their theories. "Moral hazard" and "risk aversion" are among the counters both in those theories and in insurance law. In addition to selective emphasis, the instructor might use the book to challenge students with thought-provoking exercises and probing problems of fairness and efficiency, of fitting insurance law into the matrices of tort and contract law, and of applying appropriate sanctions to wrongdoing by insurers and insureds. The editors have included, along with full-dress opinions, shorter case reports, text exposition on some topics, and innovative exercises and problems. Notes are used for various purposes: stating broad themes, reporting trends and variant views, and posing questions for reflection and discussion. The book takes notice of ground-breaking litigation, up nearly to publication date, including catastrophes of this century, "9/11" and the hurricane Katrina.

Case Studies in Disaster Response and Emergency Management (ASPA Series in Public Administration and Public Policy)
₱ 5,535.00
Galleon

Each emergency comes with its own set of challenges, however, many emergencies of the past can be used as tools to evaluate the decisions made and apply them to similar situations. Designed to enable public officials to conduct this kind of evaluation, Case Studies in Disaster Response and Emergency Management details a selection of emergencies―more than 50―that actually occurred. The book demonstrates that often there is no wrong or right answer, just choices that will resolve a problem favorably or cause the situation to deteriorate. The book illustrates the application of public administration theories and practices to real-life disasters. Arranged chronologically, the case studies involve incidents from the U.S. and worldwide, with topics including natural disasters, industrial accidents, epidemics, and terrorist attacks. It includes a set of generic questions at different points in the case study to allow evaluation of which decisions were successful and why. The decision-making process described gives readers an applied venue to test theoretical emergency management techniques that should work in real-world situations. The book demonstrates with the perspective of 20/20 hindsight how preventive planning measures are best practiced. It provides practical advice and guidance for public officials during emergency situations.

The 87 cases provide real-life applications for students and scholars of sport management. This updated second edition of Case Studies in Sport Law contains one new case study to provide a more contemporary example while maintaining the most significant precedent cases. The text is easily incorporated as a supplement to course studies, especially for its recommended companion text, Introduction to Sport Law, Second Edition . These two texts were designed with the other in mind, and the structures match each other in order of topics presented so that students can easily cross-reference the two to obtain the best understanding of sport law. The 87 cases in Case Studies in Sport Law have been carefully curated by a team of experts in the field and represent many of the multifaceted aspects of sport law. Some of the areas covered in the text are school districts, colleges and universities, interscholastic and recreational programs, professional sport franchises, sporting goods manufacturers and trademarks, and governing bodies. This broad approach encourages students to understand the impact of legal issues on the sport industry, including many of the areas that students are hoping to pursue as a career. Case Studies in Sport Law offers condensed versions of each case as opposed to the full legal proceedings, which enables students to grasp key concepts of the case instead of wading through legal jargon. The cases are divided into the main topics that are most prevalent in sport law courses: agency law, antitrust law, constitutional law, contract law, employment law, intellectual property, labor law, products liability, risk management, statutory law, Title IX, tort law, and the U.S. legal system. This is an easy-to-follow format that allows instructors and readers easy selection of cases based on the topic at hand. In addition to the abridged court cases, each section provides introductory information to prepare students on the type of law that will be examined and key concepts to bear in mind while reading. Further, each case study ends with review questions that can test student comprehension, be used for review, and prompt in-class discussions. Answers to these review questions are in the instructor guide, which is free to course adopters. Litigation and lawsuits in sport are increasing; therefore, managers and operators must maintain a thorough understanding of legal practices. Case Studies in Sport Law is the ideal text to supplement a sport management or sport law class and bolster student comprehension of sport law issues, and it is a supreme reference in the professional library of all practitioners in college, high school, professional, and recreational sport settings.

Among these are such Supreme Court decisions as Air Wisconsin Airlines Corporation v. Hoeper , which gives those who follow the post-911 instruction, “if you see something, say something!” some special protection from libel suits; Brown v. Entertainment Merchants Association , which explicitly gives maximal First Amendment protection to violent video games, even when sold to minors; U.S. v. Alvarez , which prohibits prosecution for falsely claiming one has been awarded a Medal of Honor; and Snyder v. Phelps , which gave notorious minister Fred Phelps the right to mount demonstrations with rather nasty messages at funerals. Siegel has used several criteria to select cases for inclusion in this and previous editions. He admits unabashedly that one of those criteria is the cultural significance, familiarity, and even celebrity of the controversies or the litigants. Just to cite a few examples, this edition includes cases involving such litigants as Michael Moore, Penn & Teller, Joan Rivers, and Madonna, as well as TV programs like Family Guy , CSI , Law and Order , and featured movies include Disturbia , American Gangster , American Beauty , and The Hangover, Part II.

By detailing the various processes and goals of case management and the different populations they help, the authors present a resource that is invaluable not only to social workers, but also to case managers in nursing centers, community mental health facilities, and criminal justice centers. The third edition of this book is updated to reflect the constantly changing nature of the helping professions. New and updated references provide readers with an array of options for pursuing specific aspects of case management. The book is attentive to the evolving needs of a variety of populations, and it now contains a new section on working with members of the military and their families. This edition also contains new information on case management within larger organizations that provide mental health services.

Case Studies in Pharmacy Ethics: Third Edition
₱ 3,190.00
Galleon

Pharmacists constantly face ethical choices -- sometimes dramatic matters of life-and-death decisions, but more often subtle, less conspicuous choices that are nonetheless important. Case Studies in Pharmacy Ethics identifies and discusses the broad range of ethics issues pharmacists confront in practice. Ranging from situations faced in direct patient care to broader issues, this book uses cases to explore topics and the ethical framework within which practitioners make decisions about such issues as assisted suicide, conscientious refusal, pain management, and confidentiality as well as the equitable distribution of drug resources within institutions or managed care organizations and clinical studies on vulnerable populations. As the scope of the pharmacist's role expands, pharmacists find themselves facing new ethical challenges. This third edition accounts for some of the many changes in pharmacy practice and in the delivery of health care since the second edition. It includes an entirely new chapter on health insurance and health system planning, and a discussion of the impact of the Affordable Care Act and cases that are updated to reflect current pharmacy practice models. It serves as a valuable resource regarding topics that are both specific to pharmacy practice and those that involve the health care system more generally.

Case Studies on Diversity and Social Justice Education
₱ 3,068.00
Galleon

Case Studies on Diversity and Social Justice Education offers pre- and in-service educators an opportunity to analyze and reflect upon a variety of realistic case studies related to educational equity and social justice. Each case, written in an engaging, narrative style, presents a complex but common classroom scenario in which an inequity or injustice is in play. These cases allow educators to practice the process of considering a range of contextual factors, checking their own biases, and making immediate- and longer-term decisions about how to create and sustain equitable learning environments for all students. The book begins with a seven-point process for examining case studies. Largely lacking from existing case study collections, this framework guides readers through the process of identifying, examining, reflecting on, and taking concrete steps to resolve challenges related to diversity and equity in schools. The cases themselves present everyday examples of the ways in which racism, sexism, homophobia and heterosexism, class inequities, language bias, religious-based oppression, and other equity and diversity concerns affect students, teachers, families, and other members of our school communities. They involve classroom issues that are relevant to all grade levels and all content areas, allowing significant flexibility in how and with whom they are used. Although organized topically, the intersection of these issues are stressed throughout the cases, reflecting the multi-faceted way they play out in real life. All cases conclude with a series of questions to guide discussion and a section of facilitator notes, called points for consideration. This unique feature provides valuable insight for understanding the complexities of each case.

Case Studies and Theory Development in the Social Sciences (Belfer Center Studies in International Security)
₱ 2,566.00
Galleon

The use of case studies to build and test theories in political science and the other social sciences has increased in recent years. Many scholars have argued that the social sciences rely too heavily on quantitative research and formal models and have attempted to develop and refine rigorous methods for using case studies. This text presents a comprehensive analysis of research methods using case studies and examines the place of case studies in social science methodology. It argues that case studies, statistical methods, and formal models are complementary rather than competitive. The book explains how to design case study research that will produce results useful to policymakers and emphasizes the importance of developing policy-relevant theories. It offers three major contributions to case study methodology: an emphasis on the importance of within-case analysis, a detailed discussion of process tracing, and development of the concept of typological theories. Case Studies and Theory Development in the Social Sciences will be particularly useful to graduate students and scholars in social science methodology and the philosophy of science, as well as to those designing new research projects, and will contribute greatly to the broader debate about scientific methods.

The necessity defense is considered in the context of Katrina. Negligence is critiqued from feminist, economic and other perspectives. Case s and Materials on the Law of Torts (University book Series)
₱ 19,283.00
Galleon

For more than seventy years, leading torts scholars at the Yale Law School and elsewhere have used this casebook. It unconventionally begins with strict liability. A recent study published by the Arizona State Law Journal shows that this sequence results in students experiencing a greater appreciation of “the judge’s role as being influenced by social, economic, and ideological factors and a sense of fairness and less as a process of rule application than do students who begin their study with either intentional torts or negligence.” The Sixth Edition is more accessible to students because of substantially expanded textual explanations and more tightly edited opinions. Updates include frequent discussions of Restatement (Third) provisions and a significant number of recently decided cases including several from the Supreme Court addressing products preemption, displacement in climate change litigation, and First Amendment limits on liability for intentional infliction of emotional distress. Comprehensive Changes A new appendix to the casebook, “The Litigation Process,” facilitates the student’s introduction to the torts litigation process. Relevant provisions of the recently adopted Restatement (Third) of Torts are quoted throughout the text. The Sixth Edition adds an unusual number of recently decided cases, including several from the Supreme Court of the United States addressing issues such as preemption, displacement in climate change litigation, and First Amendment limits on the tort of intentional infliction of emotional distress. The amount of textual explanation in introductions and in notes has been greatly expanded to facilitate the student’s understanding. In addition, the enhanced notes often ask students to consider newly added questions as they read the opinions and prepare for classroom discussion. The excerpted opinions are more tightly edited. The chapter in the previous edition that addressed damages has been split into two chapters, one covering “Damages” and the other, “Other Limitations on Liability Based on Type of Harm.”

Case s and Materials on Constitutional Law, Themes for the Constitution's Third Century (American book Series)
₱ 19,459.00
Galleon

The new edition of Farber, Eskridge, Frickey and Schacter’s Cases and Materials on Constitutional Law exploits the two most exciting developments in Constitutional Law teaching in the last thirty years: the judiciary’s dramatic engagement with social movements and key political debates, and academic and judicial deployment of original meaning as a central methodology. Thus, the new edition presents a most systematic introduction of original meaning methodology for law students, starting with the evolution of “originalism” in response to the academic debates over Brown v. Board of Education, and continuing with in-depth examination of what original meaning teaches us about the Fourteenth Amendment, as well as the First and Second Amendments, the Commerce Clause and other authorizations for congressional regulation, the federalist structure of the Constitution, and the separation of powers. The new edition provides in-depth treatment of the most exciting issues in constitutional law today―including the validity of affirmative action, exemplified by state discriminations based upon sexuality or gender; the imperial First Amendment, threatening to impose a new Lochner-type era of judicial review of economic legislation; the increasingly prominent federalism limitations on congressional and state authority, powerfully illustrated by the ObamaCare Case and the Arizona Immigration Case; and the limitations on the imperial presidency posed by the War on Terror Cases.

Case s and Materials on the Death Penalty (American book Series)
₱ 19,758.00
Galleon

On this fourth edition, Nina Rivkind and Steve Shatz, the authors of the previous editions, are joined by two co-authors with extensive death penalty law experience: Sam Kamin and Justin Marceau, professors at the University of Denver Sturm College of Law. This edition includes eight principal cases decided since the third edition, including Cullen v. Pinholster , the Supreme Court's leading case on the scope of federal habeas corpus and Glossip v. Gross , the Court's latest decision on execution methods, one that produced a debate among four justices about the constitutionality of the death penalty itself. All notes have been updated to reflect recent case and non-case developments concerning the death penalty, and material has been added on the perspectives of victims' families and prison officials. This casebook is a comprehensive and up-to-date treatment of the Supreme Court’s death penalty jurisprudence. Part I contains background information about the death penalty and the Court’s seminal cases. Part II addresses constitutional challenges to various aspects of death penalty schemes. Part III considers the litigation of a capital case by examining the Court's constitutional decisions regarding the process as a whole and the penalty phase, in particular. Part IV covers issues arising after the death judgment, specifically, those arising on federal habeas corpus review of the death judgment and those concerning the execution itself. Part V reconsiders the death penalty in light of international norms and from the perspectives of victims' families, prison officials who administer the death penalty, and reformers.

Case s and Materials on Trade Secret Law (American book Series)
₱ 15,996.00
Galleon

This is the second edition of the first casebook in the United States devoted exclusively to trade secret law. As with the successful first edition, it is challenging yet user-friendly to students in order to facilitate their reading and understanding of the material. It is designed to be used by law students (and business students) with no prior background in intellectual property law. Due to the breadth of the subject matter, professors who teach trade secret law need not be intellectual property experts, but can specialize in a variety of fields, including employment law, torts, and unfair competition. The casebook also provides the context to re-teach and reinforce many of the basic concepts of law that students learned as 1L’s, including tort law, contract law, property law, civil procedure, constitutional law, and criminal law. This new edition includes timely additions relating to the Defend Trade Secrets Act of 2016 (DTSA) and the EU Trade Secret Directive, two laws that went into effect in mid-2016, and which are certain to change the landscape of trade secret law in the United States and Europe. Unlike the only other existing casebook on the topic, this book continues to focus on and teach the predominant source of trade secret law in the U.S., the Uniform Trade Secrets Act (UTSA) as interpreted by courts throughout the U.S. The authors have made conscious and thoughtful decisions about the way in which the information throughout the casebook is presented and organized. The general organization of the casebook follows a logical analytical approach to understanding trade secret law with the chapters progressing from proving the essential elements of a trade secret claim to defensive tactics and remedies, managing trade secrets, and criminal actions. It also addresses employment, management, and international issues.

Case s in Health Services Management, Fifth Edition
₱ 5,852.00
Galleon

Health services management students need more preparation than ever to solve the problems they will confront in the increasingly complex health services environment. Cases in Health Services Management, Fifth Edition, presents 28 challenging cases (10 new to this edition) that address pivotal issues students will encounter as administrators and managers: quality improvement, strategic planning, ethical dilemmas, organizational dynamics, cost-benefit analyses, resource utilization, and more. Students can hone their management acumen with real-life case examples like these: *When an advance in medical technology significantly improves the outcomes of a common procedure but triples its cost, can the needs of patients, hospitals, and insurers be reconciled? * After a collapse in leadership in the face of unrest among internal staff and external service providers, can a new hospital administrator implement a culture change to introduce greater transparency and a self-management learning style? * A hospital merger requires consolidation of duplicated services and careful scrutiny of a premier burn center whose continuation or closure has financial, community, and organizational ramifications. * Deciding whether to remove an entrenched founder and CEO from a national 400-facility, multi-level long-term care health system that is in a downward financial spiral poses significant challenges to its board of directors. * The leadership and strategic planning required to manage rural hospitals emerges as a new CEO tries to turn around a struggling facility's fiscal picture and solve chronic physician recruitment problems against a backdrop of local concerns. Providing an exceptional framework for classroom discussion and practice in decision making, Cases in Health Services Management is an outstanding casebook for capstone and issues courses and a valuable supplement for health services courses in organization and management, strategic planning, finance, and marketing.
